Lektura.ch is operated by the company Lecturus Prévost (hereinafter referred to as Lektura).

§ 1 Scope of application

These terms of use govern the use of all the online services of Lektura.ch provided by Lektura. The terms of use apply to users (hereinafter referred to as “users”) of the freely accessible online services of Lektura.ch as well as to the online services of Lektura.ch requiring registration.

§ 2 Prices, conditions and right of withdrawal

The products are subject to a charge, with the exception of commercial promotions by authorisation of Lektura. The prices of the different products are clearly displayed before the payment process.

A one-time right of cancellation for the first product purchase is granted by Lektura. The cancellation of the online product purchase must be made within 14 days. There is no right of cancellation for all further purchases by the same user.

The charge is unique for the respective product purchase. It is made in Swiss Francs. The use is unlimited in time and applies to a single user per purchase transaction.

The purchaser’s payment-related data is stored in the data cloud of Amazon Web Services EMEA SARL Luxembourg (subsidiary of Amazon Web Service Inc., USA) on servers located in Ireland.

This data is therefore not subject to the Swiss Data Protection Act or banking secrecy.

§ 3 Liability and exemption

1) Lektura is not liable for the availability of the servers and the contents at any time or for the uninterrupted functioning of the online services of lektura.ch. Lektura does not assume any liability for the functioning and compatibility of the hardware used by the user. The user is responsible for the hardware he uses. Lektura does not provide any technical support related to the use of the online services of Lektura.ch.

2) The data stored by the user in his account are regularly backed up by Lektura. However, in case of loss of data, Lektura will endeavour to restore the state prior to the loss of data. However, there is no obligation to do so. Lektura shall not be liable for any loss of data and/or for any other damage incurred by the user as a result of using the online services of Lektura.ch.

3) The complete bibliography of the method is published. No complaints regarding the interpretation of linguistic content will be accepted.

§ 4 Registration and handling of personal data

1) The user chooses his login data for the registration to the online services of Lektura.ch. He is obliged to keep them secret and not to make them accessible to third parties. The user is responsible for all actions taken using his login data.

2) The user assures that the personal data entered are true and complete. Incomplete registration and untrue information will result in the rejection of the user. The user is obliged to keep his personal data up to date. Changes of address details (new e-mail) have to be made immediately. Lektura reserves the right to delete incorrect information. Such a deletion does not entail any liability for damages on the part of Lektura.

3) The user agrees that his data will be registered and electronically stored by Lektura and service providers commissioned by Lektura. The data will not be passed on to third parties. The user also accepts that in case of transmission of data within the internet there is the possibility of gaining knowledge of these data without authorisation.

4) If Lektura detects an unauthorised use of a Lektura.ch online service, Lektura may disclose the data of the user suspected of misuse to the competent authorities and inform the police and/or other authorities about the incident.

5) The user can visit Lektura.ch without providing any personal data. Only impersonal usage data such as the IP address, the last website visited, the browser used, date, time, etc. are analysed anonymously for the purpose of recognising trends and improving Lektura.ch’s online offering. No conclusions are drawn about the user.

6) In certain cases, Lektura uses so-called cookies. The user can set the browser in such a way that a warning appears before a cookie is saved and can do without the advantages of personal cookies. Certain services cannot be used in this case.

§ 5 Responsibility of the user

1) The user refrains in particular from offering and linking the following contents:

• Content which, according to general moral standards and Lektura’s decision, may be considered obscene, insulting, defamatory, offensive, pornographic, harassing, racist, xenophobic or otherwise reprehensible;

• Content that may harm the image of Lektura or Lektura.ch; 

• Content that constitutes advertising for third party companies or content that promotes sexual services, SMS or MMS services, personal loans, medicines, alcohol or tobacco products;

• Content that is likely to cause harm to others, such as viruses, Trojan horses, spyware, phishing calls or instructions on how to produce such content.

2) The use of the “Application programming interface – API” is subject to the creative commons licence Attribution-NonCommercial-NoDerivatives 4.0 International (CC BY-NC-ND 4.0).

3) Lektura is entitled to block or delete the user’s account as well as all content published by him on Lektura.ch at any time without giving reasons and without observing deadlines. This applies in particular in case of knowledge of a failure to comply with the above obligations. Such a breach may also result in civil and criminal penalties for the user.

§ 6 Changes to the terms of use and the online services of Lektura.ch

Lektura may amend and supplement these terms of use at any time. Lektura further reserves the right to modify, interrupt and temporarily or permanently discontinue the content of Lektura.ch at any time. This shall not give rise to any claims for damages or any other warranty claims on the part of the user.

§ 7 Jurisdiction and applicable law

Swiss law shall apply. Subject to any mandatory legal provisions to the contrary, the exclusive place of jurisdiction for all types of proceedings shall be Bern.
